Please read very carefully . My friend Arata does not speak English very well and signed on this service without reading. Her images are now all over different websites not listed on Fine Art America but they are owned by Fine Art America.

I tried to help Arata today and decided to read the fine print in the terms of use ,all four sections and I am amazed at the power of this company and it's rights and privileges.

Short version. It owns your images the moment that you upload them,for all their uses no matter what.
It also says it owns any and all returns to do what they want with.
Also it says that it can control and use and sell your images anywhere they want.
Also says that they can and do monitor your activities and whom you are communicating with and all personal communication and discussions .

I will make this short and sweet for those of you that do not read the terms of use. (THEY OWN YOU ,YOUR WORK ,AND YOUR SOUL) You better read the contract,which was started the moment you signed up free or not free. In not so many words. Fine Art America has all rights and you have none,

If you are an attorney or know one please have them read the full terms of use for your rights as contributors here and please read thoroughly and understand them.

Arata will be closing her site here as she opened it in error and now her priceless art is being sold without her consent everywhere.

All I ask if you care about your work and your sales and your rights,please read all the posted links in detail and please spread the word.

I too was also worried about this. It seems rather sticky and questionable. I will have my attorney look it over for clarity .

basically, after they print something - and its returned, the site can do what they want with the print, but it's usually destroyed, unless you checked off the auctioned off button.

the site does not own your images, but it does store your image. you own the copyrights.

i don't believe i ever saw any place that they can sell your images any place they want. they do have multiple names of this site, and maybe someone misread that.

because the site is internal, they do have the ability to read your mail, and of course discussions are pretty public.

this site does not own your work, soul or otherwise. contracts have to be read exactly as they are written, this list shown can't be paraphrased. don't jump to false conclusions.

I think your friend misunderstood somehow...we want our images all over the internet...and for faa to sell them. As long as they pay us when they do... all is good. I have to agree with
Mike I saw no mention of work, me or my soul in the contract.

However on this post I do give merit to this contributors remarks as I am curious myself how far the reach of Fine Art America and it's many cloaked companies extend. I personally have seen many many sites that have no marketing logos of Fine Art America carrying the members here,their comments and their works.

Mr Savad and Also Ms Arie. I suggest you read all parts of the four sections of terms of use and open your eyes and minds and understand exactly how the terminology is used and what it means,for I have also wondered about the exactness of what this person speaks about.

That said, allow me to give the short version.....

FAA does NOT own your soul, sorry, that is beyond hyperbole.

FAA can sell your image pretty much anywhere they want, BUT they then have to pay you the royalty YOU select for the size or type product the image is on. So yeah, imagine that, a company we use to sell our images for us and then pay us actually does that.

FAA does NOT own your images. You give them the rights to sell them, NOT the copyright.

That is pretty much the short version.
