Hahahahahahahaha! That's so true! It's what I suspected all along, but what the hey, I have had some sales, and I really signed up for the greeting cards, unfortunately it got too expensive to ship them to Cyprus.
I am well and truly entertained, though. It makes you wonder if a couple of the full time provocative forum members are hire-ons as well, here for our entertainment. Or maybe they are really the owner having a laugh at us.
At any rate, I love it here...I am not going anywhere...it's personal, in a good way, and that is rare in this world. That's the very best part outside of the art. Afterall I met you, V! I will never forget you or your paintings.
Who could ever forget this? It's iconic.

Maybe a Facebook for artists is really the way to go. Apparently we are as in need of entertainment as we are of sales.
BTW, this is my favourite forum shift group. It's like our own little world. Before the HI octane testosterone gets here.

The painting of my John was just a doodle on some paper during our 30th anny lunch.........it really works not to pay too much mind to the details....maybe a good memory helps,too

Nowhere does FAA / Pixels take over your copyright. You are giving FAA / Pixels permission to publish your work. On the web and, if there is a sale and you have added prices, to print and send.
You retain full rights.
Everything else on the site..images of frames through to icons etc are the property of FAA / Pixels

I've seen so many artists leave perfectly good, useful, sites -- just because they don't understand the legalese of TOS.
Too bad Kim chose to walk away, instead of asking one question. Ah, well . . .

to be honest though there should be a by line in there that does state what the copyrights are for the artist, if its there its lost in a sea of text.

It's interesting that the full text of what Kim pulled from reads --
"The copyrights to all original materials, content, selection, and arrangement of the Website (including text, user, and visual interfaces, images, look and feel, design, sound, etc. and any underlying software and computer codes) are proprietary to Fine Art America, its parents, affiliates, subsidiaries, or third party licensors..."
It makes it pretty clear to me they are talking about stuff associated with the web site. Yet she -- I'm sure, but I can't remember if Kim was a she or he; I've known some male Kims -- had to slice and dice the quote from the TOS to make it read
"The copyrights to all original materials, content, ....are proprietary to Fine Art America"
The quote couldn't have been cut up more to make it say the opposite of what thefull quote says any better, or worse, depending on your POV. I think some people look for a reason to leave this site and others and sometimes grab the first one that comes along. It's actually kinda interesting in an odd sort of way.

i think she only scanned for the terms - USER, IMAGES and that's it. if you glance at it, it could read that. i usually look for the line that says all artwork on this site is the sole property of the person who made it, or something like that.

Very interesting. In a couple of weeks, I'm going to do some editing here and pare my portfolio down to 25. I can be entertained for free (winks), and I belong to many other (free) sites that do excellent printing on photo paper, canvas, calendars, greeting cards, and other products. I'm not leaving, but I will be prioritizing. (Anita, I love your work. Let's keep in touch.)

Oh, Linda, don't pare down, you have too much good stuff! Stay and stay big, high roll with the rest of us, you will have a greater selection to buy from.
No seriously, I have had sales here, and there really is no other place like it, where you know the person in tech, and she's real artist, too, who understands, and the owner actually comes here to speak to us when we don't understand something, and listens to us, and puts up with us, and generally speaking we can really speak our minds on the forum, so we do actually get to know each other over time. It is special.
V, lol, is this your clever way of cutting down on the competition? If so, you're brill! LOL!
We are staying V! We want the right to buy our own work at a discount! To entertain ourselves! Some people pay more for cable! I am going to have so many images on here one day that I will fill the search! In fact, Linda, au contraire, flood the search with your images! upload 25,000!

regardless of what it was about, the fact that the terms could be misread so easily, means that potential customers coming to this site may never join because it doesn't have that simple like stating we own our own stuff.

I had no intention of 'stirring', as you imply happened erroneously to Kim, who already had grave misgivings about FAA, and has been the only one to be cited in this thread to have had an illogical response due to her own mis-reading of the TOS - (not the thread )................

What is an 'actual top post' to consist of, if not a direct reference to the topic? I do not understand your question, but frankly, it is no matter. I am glad the others seem to get my timely advice to just read the TOS here , as any sensible business-person should do, when in contract with a company..........

I have no intention of making this private - it is good general advice, and a place to air thoughts about the legalities,etc, of signing contracts here/anywhere, for that matter.
If you're looking for a reason to privatise this, or close it, don't bother...........

That's cool then. It is not how it read when you said it but that could be as you did not actually make any point in the top post at all so it was all open to interpretation. You did not even add a link and top posts should have some idea of what you are requiring people to respond to
Please keep off the Kim episode now as it would not be fair to discuss it when she is not part of the site any longer

.....I tried four times to simply place a live link to the post here and it would not return as 'live'..........as often does happen, just to me? don't know.
I have seen others ask why the html links are broken/unusable, without reply.
So, I put the live link in the very first post.............obviously understood by visitors who;'ve used it.......obvious I knew to do it,but couldn't....
You know, Abbie, this forum is read mostly by 'regulars' who do get it when links don't work or don't appear for good reason without the OP making explanations.........it's your job to keep things accessible to newbys also, I know...........I find your attention to this quite extraordinary though....Of course I know and don't need reminding to propose a subject for 'discussion', not just 'information'. In future I will therefore, should I care to share such information, entitle the thread "Information" FYI..............hope that's acceptable. Your thoughts? About "Information" threads? per se

I once learned the "hard way" (mostly making a fool of myself) never to sign anything until you read it - joining the site - and particularly if you are a paying premium member - and you ain't read the TOS - it's the same thing as "signing" the document. I found nothing wrong with the TOS - and am satisfied - and very often entertained as well.

Maybe I'm just a bit slow, but I don't understand what all of the controversy is about. Under the Contributor Terms of Use it specifically says:
Ownership of Images
The copyrights in and to all Images You submit remain with You as the owner of such copyrights. Nothing contained herein shall be construed to transfer any copyrights to Fine Art America or its sublicenses.
