Seller Sues For Negative Feedback!

Though Med Express claimed that it paid the full shipping cost, "for some reason unknown to Med Express, the equipment was received by Nicholls with $1.44 postage due," according to the court record. Med Express apologized immediately and offered to reimburse Nicholls for the postage due, but she went ahead and posted a "negative" comment about the charge on eBay's website: "Order arrived with postage due with no communication from seller beforehand," she wrote.

Here is the story: An eBay seller who sued two customers over their negative feedback online has been ordered to pay $19,250 to cover their legal fees.

Suing over consumer reviews - how ridiculous!

NOT frivolous, ... ridiculous! Stupidity, thus, has a cost.

A simply honest reply would have fixed it! I see it all the time on yelp. He said..... she said....

I am curious to know how if you ship something from the Post Office it can arrive with postage due? Maybe sue the post office! lol They started the ball rolling.

Easy enough, the shipper didn't put on the proper postage.

Obviously the courts decided the seller was the one going overboard. They could brought it up with Ebay or responded to the review.

on ebay they are pretty hyper about their reviews. my father got a pc, there were labels all over it, they will fix it, don't complain. and they sent us a new cd drive because it was stuck without any effort. so that was a bit odd.

on angies list, i think someone said that a baby sitter was molesting children, that was bad, hard to know if it was real, but it did effect their business.

I am talking about if you physically take something to the Post Office and have them weigh it!
Med Express said in the court filing that it "took the equipment to the Valley City post office, where it was weighed and shipped to Nicholls

I understand that some try to cheat the system with the print at home postage and simply drop it off at the Post Office.

Read in between the lines. Sellers are concerned about negative feedback because it works. It communicates to potential buyers and may effect sales. Those who sell bad products don't want potential buyers to know.

Write reviews about every product you buy online. Write them intelligently and sticking to just the facts. Avoid personalization (i.e., "this company is a bunch of crooks") and there will be no grounds for suit. State just the facts about your product experience.

Take the time to contribute because they work. I am an amazon prime member and check reviews on absolutely every product I consider. Reviews have caused me to not purchase many, many items.

Amazon/Ebay etc are tough on sellers. The customer is always right even when fraudulent buying schemes occur. Its part of doing business. Here we've grant FAA the power to conduct that end of the business. Double edge sword. We have no idea of what happens when a return shows up but then again we don't have to get upset or take it personal.

I am a 15 years, five Power Store seller on eBay. I would not have it any other way. eBay is a $9 billion a year company. When even you have that kind of money involved, some one is going to try to get a piece of it dishonestly. I would rather they error on the side of the buyer then me, the seller. The buyer has to have confidence that they are going to be protected and not get screwed.

When I have a hesitant buyer, maybe a new buyer, I walk them though the process to open a case both in eBay and PayPal. That has been 100% effective.
