Wonder how the artist would feel if someone took a photo of one of his paintings without permission and then entered it in the photography contest at the same state fair?

Ah, you see where he went wrong was not blowing it up bigger and adding some superfluous text along the bottom of the painting. Had he done that there'd have been no issue. Then again he's not a 'name' with a NY gallery backing him, so perhaps not.

bet he wishes he did not have a winner.

The photo of course harkens back to The Girl with a Pearl Earring.

The photo is excellent.

Definite case of infringement.

It was a painting which was a direct copy of an original photograph...not a duplicate photograph....that got taken down.

From what I gathered watching the video news clip, an overlay was done, and it was identical, with the exception of some of the pears.

sure, he wanted to emulate him by making an exact copy, then entering it into a contest as his own work... its always bad when its their own child in the image. i've seen similar cases where they used a photo, that could only be taken from a specific location which in that case was a private bit of land in the middle of no where.
