Thank You - All Of You For Helping Me With The Toucan Problem!

After carefully considering everything you suggested, I sent an email and here is what I received. Needless to say, I'm very happy with this!

what happened with the Oasis April 2014 issue is absolutely an unintentional
mistake and a novice choice. We were looking for a Toucan cover for this
issue and this image was presented by an intern (with the signature
cropped). We had absolutely no knowledge it was your work or else we would
have surely asked for your permission, kept your signature and credited you
inside the magazine issue.

Regarding the compensation, a monetary one of $250 (thank you for reducing
the amount) is an option that we would like to avoid being a not-for-profit
organization. We feel that for better relations with you and to market your
artwork, we are willing to offer instead to make an article feature (1-2
pages) in our September 2015 issue about you and your work mentioning your
bio and ways to purchase your art along with an apology for the April 2014
Oasis cover mistake. We hope you will appreciate our position and take this
offer into consideration. We will also surely mail you a copy of the April
2014 issue and after seeing your entire collection, we will put you in mind
in our selection of future magazine covers.

By the way, I am personally happy to have got to know who you are and see
your work. You have a lovely collection of artwork and your use of strong
colors with such great harmony reflects your confidence in your artistic
style and an unmistakable talent which is what attracted us to your Toucan.

Once again, our sincere apologies and please let us know your thoughts to be
able to proceed with the compensation we agree on and a signed release.

Congratulations! It's about as good an outcome as you could hope for. It would be incredibly difficult to pursue this overseas and with a non profit there's little money to chase. Who knows, maybe you'll get a sale from the exposure.

I totally agree, Lynn!! Besides, the advertisement is huge!! They have a very large distribution area so I'd rather have the marketing than a check any day!!

Very nice letter and outcome considering the logistics involved.

Would be a nice gesture if they sent you a complementary copy as a token of appreciation.

You have a nice international credit to add to your bio or resume as required too.

Wow! Almost restores my faith in people!

That said, the intern who intentionally cropped your signature from the photo before submitting it for publication should get the boot. It could prove a valuable life lesson to teach that individual that "novice mistakes" have consequences.

Wonderful resolution!
It's interesting to note that what they offered you, which is my opinion, is far greater than a few hundred bucks, is what many mags that contact me, (asking for free use), will offer...and I often times opt for that instead!

Oh, Marlene, I SO agree with you! Who cares about a few hundred bucks when now they've looked at my site and will consider me for more covers PLUS they'll market me!! I'll take this all day long!! Thank you, Janine! I so agree!! Kathleen, I hope it actually does restore your faith in people because I always try to go into things believing people will do what is right. I might be disappointed sometimes but I'm always going to try to look on the positive side!! Well, I'm sure they'll talk to whomever did it and perhaps the intern will learn a lesson. Regardless, he/she won't do it again! lol

Wonderful outcome ! Love it when that happens. I contacted one of the ladies on my work and she was very gracious and would like to do a an article about my work as well on her blog. We have been communicating and she is a lovely lady. So happy this worked out for you Lil !

this is such a great resolution and nice to see how it was handled. I know lots of photographers who have come across similar issues and usually it is not handled with this much professionalism.

Remember, I predicted that it was an intern's novice oversight.

Having dealt with non-profits, and knowing that they can rely heavily on interns for graphic design projects, I sensed that this seemed like a no-brainer prediction. Hopefully, the intern got some valuable education and experience out of all this.

And YOU, a feature article, and a contact for future cover prospects, as I would have hoped.

Now if an intern would just start using MY stuff, by mistake. (^_^)

I love it -- success via ignorance.
