Model And Property Releases

I actually started a conversation about this on another post, but feel it may warrant it's own thread. I found these VERY informative.

Basic starting point websites for all interested in photographing people, whether "famous" or not. Not the last word but better than relying on just the opinions of those in the forums.

Great information! The first link was the most useful, as it addresses several issues that come up on this forum fairly regularly. Fact 4 and Fact 6 of that article were especially relevant to us.

Fascinating..... Thanks for posting.

Where is Dan, he should be salivating over the perfect example of the bully sending out intimidating letters, and one photographer standing up to them and winning.

So, here's a basic question. I take a picture. I sell the picture printed on a coffee cup. Commercial use or no?

HW.....I would say most generally yes, if you are putting a photo with a trademark on an item.....you are violating their trademark.

That is also my understanding on it. This is why the case I mentioned of the Trademarked Steam Engine. Some people think they're going to be able to sell mugs, t-shirts, etc when all I want to be able to do is sell photographs of it

Lanis, thank you for the update. This case is quite old. I have to wonder what an e-mail or letter asking permission would have done? The times I have done that I have been welcomed with open arms. No lawyers needed. No property release needed. Easy peasy.

How many coffee cups HW? One? Two? Then no, it's no different than a print. 100? Yes, it's commercial use.

Try selling mugs, t-shirts, mouse pads etc with an NFL helmet on it or a Disney character. These companies have already registered their trademarks across all products.
