Why Every Fine Art Of America Member Should Do A Google Search On Your Art Or Images!!!!!!!

Greetings to all members! This topic has been discussed many times here in the discussion forum at Fine Art of America and in many cases members have discovered their art or photos have been used illegally. Recently I did a google search and to my surprise I discovered the local newspaper had in fact featured my sunflower image. I had discovered I was not given credit for taking the photo. Being a member of the on line publication over the years I would enter the monthly photo contest and I had in fact submitted my beautiful image a few years ago. Being fully aware by submitting my image the newspaper could use my image as thy deemed necessary. In this particular case when I became a member I used my on line user name and not my personal name.

This past Friday I was home working on my images and received a phone call. The caller asked was this Michael Hoard and I replied yes it was and was informed this is the editor of the New Orleans Times Picayune. The editor was so excited to finally find out the owner of the photograph and was delighted to inform me my image was corrected in the publication and the photo they used for the feature Home and Garden section was given the proper photo credit Photo by Michael Hoard. The amazing fact about my image it was an image taken with my HTC cell phone I owned years back. The cell phone camera was 6 pixels and the local newspaper used a large image of my photo for their featured story and gave me photo credit not once but twice!!!!! I was informed of the thousand of images this one image popped out from all the others which they had in their archives.

Discussions have been brought up about equipment used to take photos. In my opinion it does not matter if it is a throw away camera or the most expensive equipment. What does matter is the image taken worthy of being recognized as a snap shot or a quality photo but the individual who takes the photo as well. (Note:) this very same image has also won 1st place in a local sponsored photo contest here at Fine Art America and generously featured by member administrators in various groups I am a member.

In this particular case it benefited me as a photographer since 10 years old and I was given credit without hesitation. This and many others all included in the now growing list of personal accomplishments as a photographer. The editor had informed me they found my beautiful image in their archives but had no name to associate the photo. I strongly urge everyone to continue to do a google search regardless how many images of your art or photos it does pay off and in my personal case had a happy ending!!!!!!!!

Hello HW thank you for the post. As so many members have discovered by doing google searches and staying on top and taking the necessary legal actions for the illegal use of their images. In my particular case it is yet another recognition of my photography and accomplishments in photography. Each circumstance is different and does make you want to carefully consider when you enter photo contest those images can be used as deemed legal by the promoter, yet the artist or photographer still owns the copyright.

Hello Marlene, thank you for the post and yes it does pay off as a photographer to use your cell phone when you do not have your camera equipment at hand. This particular image was taken at the weekly public market not far from my house. Vendors gather to sell their organic produce and organic grown flowers. The question asked so many times does taking a photo with a cell qualify you as a photographer and in my opinion yes it does. It does not matter what type of equipment you use but how you achieve taking the image in the first place. My thought is does not matter who you are, what your status is professional or non-professional we all have the potential to be individual creators and from what I have viewed over the years of images taken on the newer advance cell phones are quite stunning images.

Hello Vanessa, thank you for the post and the congratulations I appreciate your input. Each individual circumstance is different and handled in courts are settled privately. In my case, the newspaper was in every legal right to use the photo as they deem necessary and did not even have to give me credit but they were more than happy to assist. As I mentioned the photo was taken over three years ago and I am glad I was given the recognition as the photographer.

I absolutely agree with you, Michael. In the hands of someone who knows what they are doing, a cell phone can be every bit as good as an expensive camera. Congrats on this nice outcome.

There has always been the discussion do photographers non professional or professional deserve credit for the various images they capture or the monetary value of those images. Also, I always wanted to acknowledge your wonderful avatar and great smile!!!!he

@Vanessa, you are right I had to smile also at Roy's comment, it would make a good title of a "song" or "book title"

Congrats Michael!

I got tracked down once for this image:

Photography Prints

The manufacturer of the chopped salt marsh hay wanted to license it for use on their Facebook page but wanted to check to see if it was indeed their product. They were very excited to see it in use because they were doing a product line extension. Expanding beyond gardeners they wanted to introduce chicken coop owners to the product.

It was kind of bizarre answering the phone and having it be someone other than Cindy from Card Services.

I don't upload images to the site and instead use their option to copy/paste my image URL links to conduct a Reverse Image Search https://www.tineye.com/ . . wonderful inspirational story . Hello Sharon, thank you so much for the great comments and mostly for the information about tineye, I will use the link you provided and give it a shot. As you have mentioned yes thanks to Fine Art America members making the suggestions they use the google search, I took advantage and use it, in my particular case I have so many photos posted it endless. Because of springs arrival I thought let me try some of my flora images and I selected the sunflower photo I took a couple of years ago. I am glad it was nothing to be overly concerned about but it was the instance a local newspaper was using my photo and without hesitation they gave me the proper credits.
