Selling Prints Or Paintings Of A Famous Person

I have seen multiple prints being sold of famous people. For example, an artist is selling prints of people famous from being actors on the show- Star Trek. Isn't there a copyright infringement? Wouldn't that artist be making money off of that actor because of his fame?

FAA can't assume that a given image based on a famous movie scene isn't licensed. Some instances are duly licensed, believe it or not. Of course, chances are, it is not. But the law doesn't (normally) make the website responsible for the unlicensed image, but rather whoever posted it. There are some extreme exceptions, such as Napster, and one wonders if Pixels/FAA is dangerously close to these extremes, in practice. But they certainly can't afford, in practical terms, to monitor each and every image uploaded and for sale here. Nominally, Pixels/FAA is quite conscientious to sever the accounts of proven violators, but it is up to the person infringed to initiate a takedown notice, and/or a complaint to the infringer and FAA.

I've seen artists that get away with it for years then suddenly the hammer falls and they are lucky if they get away with just a "cease and desist" order. It's not a game I'd ever dare play. But like Gregory says, we nor FAA have any way of knowing whether the artist has an agreement with the trademark/copyright holders or not, (I'm guessing usually not).

 

Ethics is one of the first victims when money is involved.

I would be careful about jumping to conclusions... without knowing more about about the circumstances, you really can't tell from just looking at the image of a famous person on FAA whether whoever is selling the print is doing anything wrong.

Artists sometimes use public domain images... which may be copied. Artists sometimes do ask for and receive the permissions they need to post art. Some artists are more careful about following the rules than others.

Yes it is. Unless you have the permission of the photographer.

 

There is some common sense in copyrighting that even a child would probably know... let alone adults. Of course those who don't care about their conscience will just waltz right on by anyways.

Who owns the tree? C'mon Jean Gabriel! Get your head out of those suds. LOL
