Nike Wants Photographer's Suit Dismissed.

Nike shot Michael Jordan in a post similar to a photographer's image of MJ. They then turned it into a silhouette for their ad campaigns. Nike claims his photo isn't "protected".

Ha....and then there is the artists's way of saying to the corps.... two can play ball, sort to speak....

Maybe if I took the original I'd feel differently but the case seems rather crazy to me. Two people can photograph the same thing in a similar way and the first one can sue the other one for using the photo the second one took and claim copyright?

So Peter Lik (with the money and the lawyers) could start suing people that take panoramic shots of Mesa Arch or something else he shot before he went after?

Shouldn't Nike be free to take whatever shots they want of Jordan and use them for whatever they want to use them for? They could have just as easily had someone else do a similar jump, photographed them and used it for the Jordan logo. Would the guy who took the original shot still go after them because they photographed another basketball player who looked like Jordan and then turned it into a silhouette for the Jordan brand?

That was my thought, Adam. It would set a precedent that anyone who shoots similar things to another can sue or be sued. And his image has a lot of blur in addition to not being a good pose for a silhouette. There is nothing new in the way of photography for something like this.

Sheesh. IMHO these are significantly different.

1. Right arm and hand position (arm bent vs. straight down)
2. Right leg (bent vs. straight)
3. Right foot position
4. Angle of head

Perhaps we should all be sued by the Louis Daguerre estate for photographing anything at all...
