Is This Brand Infringement Or Dose The Long Exposure And Fading Make It A Non Issue.

I did this long exposure of a gas price with some camera movement for added effect. I just put this on when I realized the sign is sort of branded with speed way(I think) but dose it mater as it's long exposure sort of kills the brand in my mind. It makes the brand hard to read and dose not have the full brand out. It has the S in the corner and another part you can read speed but I figure I am safe but am I safe in this regard. I figure I could also clam it's a political statement about high gas price and how the number's are wild and out of control but not sure if that would get me out of it. Do I need to worry about that sort of thing with long exposure photography.

Here's the bottom line, ANYBODY can sue ANYBODY! Thanks for calling..............LOL!

The law states that "art" of other logos,(Campbell Soup), buildings,trademarks,etc. is legal to sell for "non-commercial"purposes, like art work. WHat you can't do, is take a logo or trademark and then sell it as stock, for an ad or billboard, since then it becomes purely commercial and you don't have the legal right to sell that usage.

With that said, there really isn't anything in this image that shouts, Exxon, or Texaco, or BP, so you're fine. As long as you keep this as a non-commercial product, you won't be bothered. If you decide to make this into a calendar and have Walmart sell it, then the black and white,becomes gray and that's where those greedy lawyers come in!

Rich Franco : That is a good point apple sued over the swipe to unlock thing.... That is sort of a crazy thing to sue about,. looking back at the image it is rather hard to tell what sing it's from. The many S,s may be anything so perhaps it is fine.

Now to your Walmart question on this site we sell the pillow's. Would it be wise not to sell pillow's of something where it may fall into the gray
