That one is hard to figure out. The guy can't possibly be as big a jerk as that email makes him seem. Can he?

He's a thief trying to take the high road before he steals from you.

I'd respond by telling him he does not have permission to use it and if that if he does, you'll will sue his butt.

Tell him no and that you will be frequently watching that site! YIKES!!!

Andy Holmes

If it was me, I'd begin by thanking him for his interest in my work.

Then I'd point out that copying and using my work without permission, is an illegal act.

Finally I'd invite him to give full details of the intended usage, so that I can quote him a price for the relevant licence.

How to make this image like hot iron? :)

Barbara Leigh Art

I like Andy's approach

Andy's answer was perfect

Andy's answer is much more polished and refined than my advice... LOL

The thing is if you quote him a price and he uses it without your permission it will be easy to prove he knew he was dong wrong by taking your image. Save all the emails.

Problem is he claim to be from The Netherands (wherever that is) so enforcing anything might be a problem.

WTG Andy!! You get it! Right answer!

"He's a thief trying to take the high road before he steals from you."

I was reading in the paper just the other day how many back robbers and burglars do that very thing! lol

Viktor, see if there is not some way to turn this into a positive. But you can not start out with a threat.

Andy has the right idea! There will always be an opportunity to "moon" him. (RE: Mike's cartoon, that I really did think was funny) But there is only one opportunity to turn it into something good.

WOW! Great action shots Andy! I hope you have a lot more to add. That is really good stuff.

Floyd, you right I thinki to turn this situation into positive experience.
Thanks,Andy,good words!

Thanks all, and especially to Floyd for the encouragement.

I'm new here, and to the idea of turning my photography into art, but not to the industry itself.

I've been underwhelmed by the response to my action and sports work in the traditional licencing model, so i'm looking for a different outlet.

Yes Floyd, I have lots more but I'm trying to upload as wide a variety of work as possible in my initial 25, to test the water here.

I also have lots of sequences, that I'm considering turning into multi panel panorama format prints, if I can work out the logistics.

Finally, Viktor, good luck with your negotiations.

No, I wouldn't read this as a threat at all.

I deal with people all over Europe and whilst most of them speak English pretty well (far better than my German or Italian), guess what - it's not their first language and things don't always come across how they are meant.

It could simply be an awkward way of saying the internet copy is good enough if he has permission or a host of other similar meanings.

So how about digging a little deeper to find out what he means before crucifying him for having the gall to ask permission.

Perhaps someone would care to respond to him in Dutch?

Where exactly is the ultimatum?
A thief is not going to alert you to where he is going to use the image he has stolen.
The guy is telling you upfront he'd like your permission. The ball is in your court...decide if you want to grant permission and then proceed by telling him at what cost, if any.
I have given permission on several occasions to be part of a project, with no fee attached.

viktor,

Assume the author does not know the law. Assume he has not published before so he has not had
anyone steal his copyrighted material.

You might add to Andy's words to the effect, "as you become published you will find yourself supporting
copyright laws to protect your property. I have to protect my art as property, but you can license the work".

Hm..Marlene you gave different aspect of this game. And no fee? What's your point?

Marlene Burns

I have been humbled and honored to be asked to be part of something far greater than my art....and when I am, I always jump at the opportunity.
Then again, I'm not just in it for the $$....I do what I feel is right and ya know, the money comes.....

Here is copy of my response:
Dear,...
all my images posted online are subjects to international law of copyright.
Saying that, using my images without my permission is an illegal act ,at least, in America and Europe.
I like to know what is purpose of publishing your book, do you have budget for it,
and reasons why I need consideration on your offer.

It sounds to me not like ultimatum in the message, I can see there just uncertain use of english. As per my observation in Netherlands :-)
