The Bizarre State Of Copyright

The Bizarre State of Copyright, as presented by, Hank Green.

For those not familiar, Hank, and his brother, John Green, make up the video blogging team known as The Vlog Brothers. They begin each video by greeting the other brother.

This video is less than a week old. I am confident it will be of great interest to the majority of FFA membrers.

yacht parties. copyright infringers always assume that the copyright holder is just rolling in cash. it makes me angry. i work hard on my art. i am not rolling in cash, but this video gives the impression that anyone can steal anyone else's stuff an put it on youtube and get money for it no problem.

Here is one that is less cute, but more informative, from an actual copyright lawyer. "Don't steel my art" Steve Schlackman

Hi, Kim.

I believe that if you are assuming that Hank Green is endorsing copyright infringement you are badly mistaken.

He is merely pointing out the crazy situation that copyright is now in.

well, best solution to clear some of this complex terminology etc is to visit wipo i would say.

@ walter, he claims that the copyright holder just has to sue to get the copyright infringer to back pay them from the infringer's revenue stream. This is an endorsement of copyright infringement. "I get to violate copyright without worrying that my youtube channel is going to get taken down". "Rights holders get an alternate revenue stream so that they can have bigger and more fancy yacht parties". He proposes it as a "solution". 1) right holders would get nothing unless they sued the infringer. 2) right holders are portrayed as rich. Not every rights holder is a megalith international corporation. I trust what the copyright attorney has to say more.

Sorry, Kim, I did not read it as an endorsement for violating copyright. I could be wrong. Yet, any endorsement notwithstanding, he does make it clear that the state of copyright is indeed bizarre.

Here is another of his videos re copyright.

In this video Hank deals with both sides. The non copyright holder, as well as the copyright holder.

Also keep in mind that for the most part Hank is dealing with youtube videos and not individual images.

This is a very good basic tutorial for “fair use”.

By the way, the people in this video are in fact lawyers. Yet pay attention. They state clearly in the beginning that this is not specific legal advice.

“You shouldn't take this as legal advice. We're lawyers, but we're not here to give you legal advice today. We can't tell you what you can, and can't do, in any specific circumstance. Take today's discussion as general guidance, and things to consider.” --- Anthony Falzone, Executive Director of the Fair Use Project

I learned a great deal from watching this, regarding copyright , and hope others will as well.
