Posting Antique Photos Into A Contest

I'm curious as to the ethics of posting antique photos into a contest. An example is the recent Bicycles contest. A photo from 1903 was entered and clearly could not have been made by the person entering the photo. I believe that the photo being entered should have been taken by the person entering the competition. Am I correct or are the rules wide open?

Hi Geraldine.. It may have been edited a little. There are a few artists on here that like to find Public Domain pics, modernize them a little, and then sell them as original.. I don't agree with it myself.. but it's legal. hey ho :-)

Perhaps it may have been a deceased family member's photo for which they would own the copyright and thus have the right to post or sell as they wish.

I don't think she is questioning the legality of it...just the idea that they entered it in a contest. Seems like that should be the entrant's own work.

If the picture has been edited with textures added or partially colorized etc, then It could be considered the artists own..to a degree.. I still disagree with it!

I don't agree with it either but the contest administrator needs to make it clear regarding original work.

You guys know the contests are just another way to get your stuff seen right? What difference does it make? If its your contest, you make the rules, you delete or keep whoever you want. Its one image in what? hundreds of entrants?

This is a very interesting thread, I'm not a photographer and would like to be one someday after I retire... a long time from the present. I am getting familiar with Adobe Illustrator and photoshop and wouldn't know this is poor ethics, so this is good to know. I have a lot of old photos I want to fix.
