Imdeindemnification Clause Wording

i'd like to update my contract to include a line that holds me not responsible for an item a customer may make out of my art. does anyone know the proper wording for it? thanks

Same as Lutz but a little more specific and shorter.
The copyright holder of this original image is not responsible for any image modification made by a second party. Using the word "Customer" is too specific. Anyone could snag the image from the web and they may or may not be a "Customer."

Edit: I guess it's not that much shorter, but a little more inclusive.

However, not sure you really need this at all. How on earth could you be held liable for alterations someone else makes to your original image without your permission or approval??

the clause would be placed on my contract for products that are made with my image on it. so while my art didn't cause the glass to break and there by cut their hand, i want to make sure of that.

lets say its an image that is seizure inducing, and it's used in a place where there are either people prone to that

lets say this one. and people were hurt because of it.

or for unknown things that could lead it back to me...

a while back i read where a suncatcher - a bevel, set a house on fire. the light went through the bevel and like a magnifying glass, the curtain caught fire. now i don't think my products would do that, but anything to keep a lawyer away the better.

the clause would basically state that i would be held totally harmless, i would take the one from the pixels contract, but i'm not sure that's worded right. in court wording is everything.

You agree to defend, indemnify and hold Mike Savad harmless from and against any and all claims, damages, costs and expenses, including reasonable attorney's fees, arising from or related to Your use of the image.

i'll use what abbie says, it's readable and still lawyerish. it's just one of those odd phrases that my intuition says should be there, because you never know...

Whenever you do with Mike Savad prints you are at your own risk and be held liable for yourself and print damage including removing tools,machines,shops,apothecary,coffee tables,flowers,people,key words reserved,and reasonable attorney's fees withheld from your account indefensibly .

trolling is when you go out of your way to either call someone out in a public forum or otherwise set out bait hoping someone will attack back. in other words, provoking and instigating.

I think you trolled Bill's tread but it is happens there. I have no intention to discuss Bill here. BTW did you red his last post?
Anyway, if you feel I am not productive here I will stop my suggestion. I feel that I tried to fill the protection case with more specific words related to your case.
If you do not need protection from somebody who stolen you instruments and using for actions not that intended for, what do you want?

if i was trolling his thread i would have been banned, i was trying to help him, i never suggested any case, and i only stock out certain images, i'm only looking for legalese. the line is there to protect me - or anyone who is making a contract - that states that if someone uses a product that happens to have my image on it, i'm not some how responsible for that product. in otherwords it breaks the chain at that link, i can't be dragged into court because my image was on the cup that spilled hot coffee on someones lap.

I believe Viktor was trying to help you with his first post here, and was unfairly attacked due to something that happened in another thread entirely

I think he should be thanked for trying to help you by adding things that may help, commended for trying even though English is not his first language, and that other threads are NOt this one
