Are County Prosecutors Above the Law in Arizona?

Malicious Prosecution and Prosecutorial Misconduct are Overlooked, Covered-up, and Allowed in Arizona because ¡°It¡¯s Easier to Keep an Innocent Man in Prison than to Expose a Person in Power¡± according to some AZ Attorneys.

ARIZONA ¨C January 20, 2015 ¨C This is not just another story of a wrongfully convicted person; this is a rare case that has overwhelming evidence that shows Yavapai County prosecutor Sheila Polk and former Prescott PD detective Anna Cahall violated laws as well as the rules of court in 1998 to knowingly charge and convict an innocent man, Tim Casner, for crimes he did not commit. Casner¡¯s trial attorney, John Sears, told him in a letter dated January 11, 2007, ¡°I do believe (and you should know) that you were the victim of a zealous prosecutor and an aggressive police officer¡±. Casner was also excessively sentenced to over 26 years without the possibility of parole for non-dangerous, non-violent burglary charges. The AZ ABC news investigators aired a series of news stories in 2012-2013 which show small pieces of this twisted case.

Sheila Polk, now Yavapai County Attorney, has been there for every step of Casner¡¯s appeal process, blocking any attempt at proving his innocence and making sure that all his appeals were denied. In June 2013, Polk showed up at Casner¡¯s Phase Two Clemency hearing and lied to the Clemency Board members to keep this innocent man locked up, a man who prior to these bogus burglary charges - had NO criminal record, in a case where there was not one piece of evidence (physical or circumstantial), and after Casner had served 14 years as a model inmate with no trouble and a perfect work record. Shortly after this hearing, Casner received a letter from his appeals attorney, Anders Rosenquist, stating; ¡°she (Polk) mislead the Board by making statements that were not true or taken out of context¡±. Why did Polk do this? She must continue the cover up of her misconduct and malicious prosecution to avoid incrimination and remain in power. She knows that when Casner gets out of prison, he will expose his evidence of her unethical and illegal tactics in his case and she will be up on criminal charges.

Casner filed a complaint and request for an investigation against Sheila Polk in July 2014 with the FBI - Phoenix Division, AZ Governor, and AZ Attorney General for her past and continued misconduct in his case. All of these agencies dismissed his complaint without investigation. In November 2014, Casner filed a complaint with the AZ State Bar Association against Sheila Polk and is waiting for the outcome.
